Public Benefits for Immigrants

Proposed Changes to Public Charge: What This Means for Immigrant Access to Public Benefits

The federal government has released a proposal to change the way that receipt of public benefits affects immigrants’ application for legal permanent residency (obtaining their “green card”). This proposed change to the “public charge” rule is not final.

These changes do not affect who is eligible for public benefit programs that deliver critical support for health, nutrition, housing, employment, and child care. We want to help you continue to receive the assistance that you and your family are eligible to receive and need now.

Read our Frequently Asked Questions for additional information about the proposal and updates. Free community legal advice is available to help understand how any proposed changes might – or might not – affect your immigration status. Call Bay Area Legal Aid's Legal Advice Line at (800) 551-5554 for questions about public benefits and public charge, or find community-based immigration legal services at immigrants.sfgov.org.
