IHSS Care Provider Respond to Timesheet Violations

Timesheet violations

  • Initial violation: IHSS will try to contact you by phone or mail to inform you of the overtime violation. The county will automatically waive this first violation to serve as warning and training experience.
  • Violation 1: IHSS will send you a violation notice.
  • Violation 2: IHSS will send you a violation and a one-time offer to have the second violation waived by completing the self-training instructional materials.
  • Violation 3: Your provider status will be suspended for 90 days.
  • Violation 4: Your provider status will be suspended for 12 months and required to re-enroll with IHSS. You may also be required to get fingerprinted again.

Violation appeals

To appeal any violation, you can:

  • Submit Form SOC 2272 (included with each violation notice) within 10 calendar days. IHSS will mail you its decision on your appeal within the next 10 business days.
  • Appeal the third and fourth violations at the county level.
  • Once you've received a county ruling, you can appeal the third and fourth violations at the state level. You have 10 days prior to your suspension to submit an appeal to the state.
